Welcome to AirTool.nz ("AirTool", "we", "our", or "us"). By accessing or using AirTool.nz, you agree to these Terms & Conditions. If you do not agree, please do not use the platform.
1. About AirTool
AirTool is a platform that helps connect people, tools, skills, knowledge, and local services. AirTool is primarily a marketplace and service platform and is not the owner of most tools listed on the platform.
AirTool may facilitate:
- Tool rentals
- Tool sharing
- Tool listings
- Tool sales
- Tool-related information
- DIY guidance
- Connections with tradespeople, handy people, and service providers
2. User Eligibility
AirTool may suspend or terminate accounts at its discretion.
You must:
- Be at least 18 years old
- Provide accurate information
- Have the legal capacity to enter into agreements
- Comply with New Zealand laws
3. User Types
Users may participate as:
- Renters — Individuals or businesses seeking access to tools
- Tool Owners — Individuals or businesses listing tools
- Service Providers — Tradespeople, retired professionals, contractors, consultants, or businesses offering services
4. Booking Models
AirTool supports different booking models. AirTool Managed: AirTool assists with booking management and transaction processing. Owner Approved: Tool owners decide whether to accept or decline booking requests. AirTool does not guarantee that a booking request will be accepted.
5. Payments
Payments are processed through approved payment providers. All pricing is displayed before confirmation.
Fees may include:
- Rental fees
- Deposits
- Service fees
- Delivery or pickup fees (where applicable)
6. Deposits
Some listings require a security deposit. AirTool reserves the right to investigate disputes.
Deposits may be fully refunded, partially refunded, or retained in whole or part depending on:
- Damage
- Loss
- Missing accessories
- Excessive cleaning requirements
- Late returns
7. Tool Condition
Renters must inspect tools upon collection and report issues promptly.
Tool owners are responsible for:
- Providing accurate descriptions
- Listing known defects
- Maintaining safe operating condition
8. Safe Use
AirTool does not provide professional engineering, electrical, construction, or safety advice. Users assume responsibility for their use of tools.
Users must:
- Follow manufacturer instructions
- Follow safety requirements
- Use tools only for lawful purposes
- Operate tools competently
9. Damage, Loss & Liability
Renters are responsible for damage or loss occurring during the rental period except where caused by pre-existing defects. AirTool may assist in dispute resolution but is not liable for the following except where required by New Zealand law:
- Personal injury
- Property damage
- Business losses
- Indirect losses
10. Community Standards
AirTool may remove listings or suspend accounts.
Users must not:
- Harass others
- Provide false information
- Circumvent the platform
- Conduct fraudulent transactions
- Use AirTool for illegal purposes
11. Off-Platform Transactions
Users must not use AirTool to arrange transactions and then intentionally bypass the platform. Repeated violations may result in account suspension.
12. AI Information & Tool Guidance
This information is provided for general informational purposes only. Users must verify information independently before relying on it.
AirTool may provide:
- AI-generated descriptions
- Maintenance guidance
- Safety summaries
- DIY suggestions
13. Service Providers
Users should conduct their own due diligence.
AirTool may connect users with tradespeople, handy people, retired professionals, and service businesses. AirTool does not guarantee:
- Quality of work
- Availability
- Licensing status
- Outcomes
14. Intellectual Property
The AirTool name, logo, platform design, and content are owned by AirTool or its licensors. Users retain ownership of content they upload but grant AirTool a licence to display and use that content for platform operations.
15. Privacy
Use of AirTool is also governed by the AirTool Privacy Policy. Personal contact information is not publicly displayed unless explicitly authorised by the user.
16. Limitation of Liability
To the maximum extent permitted by law, AirTool's liability is limited to the fees paid through the platform relating to the relevant transaction. Nothing in these Terms excludes rights that cannot be excluded under New Zealand law, including rights under the Consumer Protection New Zealand consumer protection framework.
17. Changes to These Terms
AirTool may update these Terms from time to time. Continued use of the platform constitutes acceptance of any updated Terms.
